OF ENROLLMENT AND PARTICIPATION
RC PRESSURE WASHING TX TRAINING DAY PROGRAM

Acceptance of Terms

By purchasing, enrolling in, accessing, attending, downloading, viewing, or otherwise participating in this program, course, workshop, training day, coaching session, digital content, printed materials, live demonstration, field training, or related services (collectively, the “Program”), Participant acknowledges that Participant has read, understood, and agreed to be bound by these Terms and Conditions, as well as any posted policies incorporated by reference.

If Participant does not agree to these Terms and Conditions, Participant must not enroll in, access, or participate in the Program.

Educational and Informational Purpose Only

The Program is provided strictly for educational, informational, and general training purposes only. The Program is intended to share general knowledge, methods, concepts, examples, opinions, demonstrations, and business or field observations relating to pressure washing, soft washing, sales, operations, safety awareness, and related topics.

The Program is not legal advice, tax advice, accounting advice, engineering advice, insurance advice, OSHA compliance advice, environmental compliance advice, or professional advice of any kind. Participant is solely responsible for obtaining advice from Participant’s own attorney, accountant, insurance professional, safety consultant, equipment manufacturer, chemical supplier, and other licensed or qualified professionals before acting on any information provided in the Program.

No Employment, Partnership, Agency, Franchise, Joint Venture, or Affiliation

Participation in the Program does not create any employment relationship, partnership, joint venture, agency relationship, franchise relationship, representative relationship, broker relationship, contractor relationship, fiduciary relationship, or other legal business association between Participant and RC Pressure Washing TX, its owner, affiliates, instructors, agents, contractors, representatives, or related persons.

Participant is not an employee, partner, agent, franchisee, spokesperson, legal representative, or authorized operator of RC Pressure Washing TX by virtue of purchasing, attending, or completing the Program. Participant has no authority to bind RC Pressure Washing TX in any manner, make promises on its behalf, use its name to obtain work, collect money in its name, or represent to any third party that Participant is affiliated with or endorsed by RC Pressure Washing TX unless a separate signed written agreement expressly says otherwise.

Participant agrees not to state, imply, advertise, or suggest that Participant is “with,” “part of,” “trained and certified to operate for,” “backed by,” “insured by,” “approved by,” or “legally connected to” RC Pressure Washing TX in any way unless RC Pressure Washing TX has provided prior written authorization in a separate signed agreement.

Independent Responsibility of Participant

Participant understands and agrees that Participant alone is responsible for all actions taken before, during, and after participation in the Program. This includes, without limitation, Participant’s own:

business formation,

licensing,

permits,

insurance,

vehicle compliance,

equipment setup,

equipment maintenance,

chemical handling,

jobsite practices,

safety procedures,

hiring decisions,

pay practices,

marketing,

advertising,

sales representations,

customer contracts,

service quality,

damage prevention,

legal compliance,

tax compliance,

environmental compliance,

wastewater management,

and all work performed for any third party.

Participant accepts full responsibility for independently verifying whether any training content is appropriate for Participant’s specific equipment, property type, jobsite condition, surface material, stain type, chemical concentration, water source, weather condition, local law, state law, federal law, or insurance requirements.

No Guarantee of Results, Income, Customers, or Business Success

The Program does not guarantee any particular result. RC Pressure Washing TX does not promise or guarantee that Participant will earn money, start a business, obtain customers, make sales, avoid losses, pass inspections, remain compliant, perform work correctly, avoid property damage, avoid injury, or achieve any specific outcome.

Any examples of pricing, earnings, margins, sales, revenue, leads, business growth, marketing performance, or operational success are illustrative only and are not promises, guarantees, or predictions of what Participant will achieve. Actual outcomes depend on many factors outside the control of RC Pressure Washing TX, including Participant’s experience, effort, judgment, location, market conditions, licensing, insurance, equipment, sales ability, and regulatory compliance. The FTC warns against misleading money-making or coaching claims, so this clause is worth keeping strong and clear.

Safety and Compliance Obligations

Participant understands that pressure washing, soft washing, ladder use, roof access, chemical application, surface cleaning, pump use, hoses, electricity, vehicles, and related field activities can involve serious risks, including property damage, bodily injury, illness, death, fire, chemical exposure, slip and fall hazards, overspray damage, equipment failure, and environmental violations.

Participant agrees that Participant is solely responsible for:

(a) using appropriate caution and judgment;

(b) reading and following all manufacturer instructions, safety data sheets, labels, warnings, and manuals;

(c) obtaining and wearing proper personal protective equipment;

(d) complying with all applicable federal, state, county, city, HOA, property-owner, stormwater, wastewater, environmental, and jobsite requirements;

(e) determining whether Participant is competent and qualified to perform any work discussed in the Program; and

(f) declining to perform any activity that Participant cannot perform safely and lawfully.

RC Pressure Washing TX is not undertaking to supervise Participant’s future work, approve Participant’s methods, or certify that Participant is legally compliant, professionally qualified, or safe to operate.

No Warranty; Program Provided As Is

To the maximum extent permitted by applicable law, the Program and all related content, materials, forms, checklists, templates, videos, live sessions, field demonstrations, downloads, and information are provided “AS IS,” “WITH ALL FAULTS,” and “AS AVAILABLE,” without warranties of any kind, express or implied.

To the maximum extent permitted by law, RC Pressure Washing TX disclaims all warranties, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, noninfringement, performance, or suitability for Participant’s intended use. Texas law generally permits conspicuous warranty-disclaimer language in contracts, though enforceability depends on context and the nature of the transaction.

Without limiting the foregoing, RC Pressure Washing TX does not warrant that the Program will be uninterrupted, error-free, current, compliant with any specific law, or suitable for Participant’s particular equipment, jurisdiction, business model, or job conditions.

Assumption of Risk

Participant knowingly and voluntarily assumes all risks associated with participation in the Program and with any later use or attempted use of any information, technique, method, suggestion, demonstration, equipment idea, process, business strategy, form, or material discussed in the Program.

Participant understands that observing or receiving information about a task does not make Participant competent, licensed, certified, insured, or qualified to perform that task.

Release and Limitation of Liability

To the fullest extent permitted by applicable law, Participant releases and agrees to hold harmless RC Pressure Washing TX and its owner, officers, members, managers, employees, contractors, instructors, agents, affiliates, successors, and assigns from and against any and all claims, demands, causes of action, liabilities, damages, losses, fines, penalties, costs, and expenses, including attorney’s fees, arising out of or related to:

(a) Participant’s enrollment or participation in the Program;

(b) Participant’s reliance on any Program content;

(c) Participant’s business decisions or work performance;

(d) Participant’s use or misuse of equipment, chemicals, ladders, pumps, hoses, or tools;

(e) any injury, death, property damage, overspray, staining, etching, oxidation damage, electrical event, environmental issue, runoff issue, wastewater issue, code issue, or customer dispute;

(f) Participant’s failure to obtain insurance, licensing, permits, or professional advice; and

(g) Participant’s violation of law, regulation, safety requirements, or manufacturer instructions.

To the fullest extent permitted by law, RC Pressure Washing TX shall not be liable for any indirect, incidental, special, exemplary, punitive, consequential, or lost-profit damages, and any direct damages shall be limited to the amount actually paid by Participant for the Program that gave rise to the claim.

Nothing in these Terms is intended to waive liability where such waiver is prohibited by law, and nothing here protects against intentional fraud or deliberate misrepresentation. Texas consumer-protection law still applies to deceptive trade practices, so the document should be strong but not overstate what can legally be waived.

Indemnification

Participant agrees to defend, indemnify, and hold harmless RC Pressure Washing TX and its owner, officers, members, managers, employees, contractors, instructors, agents, affiliates, successors, and assigns from and against any third-party claim, demand, suit, investigation, loss, damage, fine, penalty, cost, or expense, including reasonable attorney’s fees, arising out of or related to:

(a) Participant’s acts or omissions;

(b) Participant’s business operations;

(c) Participant’s services to any customer or property owner;

(d) Participant’s advertising or representations;

(e) Participant’s injury to any person or damage to any property;

(f) Participant’s use of chemicals, machinery, vehicles, or equipment;

(g) Participant’s violation of these Terms or applicable law; or

(h) Participant’s false claim of affiliation with RC Pressure Washing TX.

No Certification, License, or Regulatory Approval

Unless expressly stated in a separate signed writing, the Program does not grant any state license, trade license, professional certification, legal authorization, insurance approval, environmental approval, or government-recognized credential. Completion of the Program does not authorize Participant to hold themselves out as certified, licensed, insured, approved, bonded, compliant, or legally qualified to perform any specific work.

Intellectual Property and Limited License

All Program materials, including but not limited to videos, presentations, worksheets, checklists, scripts, forms, templates, manuals, language, branding, page layouts, downloads, logos, graphics, and written content, are the property of RC Pressure Washing TX or its licensors and are protected by applicable law.

Participant receives a limited, non-exclusive, non-transferable, revocable license to use Program materials for Participant’s own internal educational use only. Participant may not copy, reproduce, republish, distribute, sell, sublicense, post publicly, record, screen-capture for resale, teach as Participant’s own paid course, or commercially exploit any Program material without prior written consent.

Participant may not remove copyright notices, proprietary notices, disclaimers, or identifying marks from Program content.

Confidential and Proprietary Business Methods

Participant acknowledges that parts of the Program may include proprietary workflows, pricing approaches, sales systems, processes, scripts, training structures, documents, or operational methods developed by RC Pressure Washing TX. Participant agrees not to share paid materials publicly or distribute them to others who have not separately purchased access.

Nothing in this section prevents Participant from using general skills and experience learned, but it does prohibit unauthorized copying or redistribution of the actual materials and content.

Participant Conduct

Participant agrees to act professionally and lawfully during the Program and in any related group, community, event, field demonstration, or communication platform. RC Pressure Washing TX reserves the right to remove any participant, without refund where permitted, for disruptive conduct, harassment, unsafe behavior, illegal activity, misuse of materials, threats, discrimination, intoxication, repeated profanity toward staff or participants, or conduct that RC Pressure Washing TX reasonably believes creates risk to persons, property, reputation, or operations.

Payment Terms and Refund Policy

All Program fees are due as stated at the time of purchase. Unless a separate written refund policy is expressly provided at checkout, all sales are final and nonrefundable once access has been granted, materials have been delivered, or a live training seat has been reserved.

If a payment plan is offered, Participant remains responsible for the full balance. Failure to complete payments may result in suspension or termination of access and collection of outstanding amounts to the extent permitted by law.

If Participant is removed for violating these Terms or for unsafe or unlawful conduct, Participant is not entitled to a refund unless required by law.

Scheduling, Rescheduling, and Program Changes

RC Pressure Washing TX may modify dates, times, instructors, lesson order, delivery format, modules, location, examples, or training structure as reasonably necessary. RC Pressure Washing TX may substitute virtual delivery, reschedule a live session, or cancel a session for weather, safety, illness, operational conflicts, low attendance, property access issues, or circumstances outside reasonable control.

Participant understands that field demonstrations are subject to changing site conditions and may not cover every surface, method, or scenario.

Use of Participant Name, Likeness, and Feedback

Unless Participant provides written notice opting out before the event or unless prohibited by law, Participant grants RC Pressure Washing TX permission to use Participant’s name, voice, image, likeness, testimonial, comments, questions, and non-confidential feedback from the Program for internal records, training improvement, and lawful marketing purposes, without additional compensation.

Participant represents that any testimonial or statement given will be truthful and based on actual experience.

Communications and Electronic Consent

Participant agrees that RC Pressure Washing TX may provide notices, disclosures, policies, updates, invoices, and other communications electronically, including through email, website posting, text, checkout page, portal, or other electronic means. Texas recognizes electronic records and signatures in qualifying transactions, so acceptance by checkbox, online signature, or similar method may be legally effective.

Privacy and Data

RC Pressure Washing TX may collect and store Participant’s contact information, payment-related transaction records, enrollment details, attendance records, communications, and submitted assignments or forms for business, operational, legal, educational, and customer-service purposes.

RC Pressure Washing TX does not guarantee that online systems are completely secure and shall not be liable for unauthorized access caused by third-party platforms, cyber events, or circumstances outside reasonable control, except as otherwise required by law.

No Third-Party Beneficiaries

These Terms are for the benefit of the parties only and do not create rights in any third party.

Governing Law

These Terms and any dispute arising out of or relating to the Program shall be governed by and construed under the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.

Venue and Jurisdiction

To the fullest extent permitted by law, Participant agrees that any dispute arising out of or relating to the Program shall be brought exclusively in the state courts located in Harris County, Texas, or, if federal jurisdiction exists, in the appropriate federal court serving Harris County, Texas, and Participant consents to such jurisdiction and venue.

Texas law generally enforces contractual venue-selection clauses in qualifying agreements, but a Texas attorney should still review this clause for your exact sales setup and contract size.

Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

No Waiver

Failure by RC Pressure Washing TX to enforce any provision of these Terms shall not constitute a waiver of any right or provision.

Entire Agreement

These Terms, together with any checkout terms, posted policies, written refund policy, and any separate written agreement signed by both parties, constitute the entire agreement between Participant and RC Pressure Washing TX regarding the Program and supersede prior discussions or understandings relating to the Program.

Modifications

RC Pressure Washing TX may update these Terms from time to time for future enrollments. The version accepted by Participant at the time of purchase or enrollment will govern that Participant’s enrollment unless Participant later affirmatively accepts an updated version.

Acknowledgment

By enrolling in or participating in the Program, Participant expressly acknowledges and agrees that:

(a) the Program is for informational and educational purposes only;

(b) Participant is not legally connected to RC Pressure Washing TX by virtue of participation;

(c) Participant is not an employee, partner, agent, franchisee, or representative of RC Pressure Washing TX;

(d) Participant is solely responsible for Participant’s own business decisions, safety practices, compliance, and work performed;

(e) RC Pressure Washing TX is not responsible for Participant’s misuse, misunderstanding, or improper application of any information provided; and

(f) Participant has had the opportunity to consult independent legal, tax, insurance, and safety professionals before relying on the Program.
